Terms of service
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by a customer (hereinafter "Customer") through the online shop of MTC – More Than Cycling (Online Shop), operated by MTC GmbH, Dietlikon, Switzerland (MTC GmbH), or submitted to MTC GmbH by any other means. By using the Online Shop or by submitting an order through any other channel, the Customer accepts these GTC.
2. Conclusion of Contract
The presentation of products in the Online Shop, in documentation, or on site does not constitute a legally binding offer. By submitting an order, the Customer makes a binding offer to purchase. After receipt of the order, the Customer receives an automated acknowledgement of receipt. Should a product not be available, the relevant order will be cancelled. MTC GmbH is entitled to reject an order in whole or in part without stating reasons. The order confirmation sent by email after review of the order constitutes acceptance of the offer to purchase, subject to the availability of the ordered product.
3. Prices and Payment
Price information is non-binding. Price and product adjustments are reserved. All prices are net in Swiss francs (CHF) and include statutory value added tax. Shipping costs are shown separately. We accept the following means of payment: credit card, bank transfer, TWINT and PayPal. The invoiced amount must be paid within the stated deadline. Upon expiry of the deadline, the Customer is in default without a reminder. Payment of the price must be received no later than three business days before dispatch or delivery.
4. Delivery and Shipping
Delivery times vary depending on product availability. Individual delivery times apply to Custom Builds and special-order items and will be communicated separately. The delivery periods or delivery dates communicated are non-binding. Delivery delays do not give rise to any right of withdrawal on the part of the Customer and no claim for damages.
Delivery is made to the delivery address specified by the Customer. MTC GmbH bears the risk of loss or destruction of the product until its dispatch (handover of the product to the carrier). If the Customer is in default of acceptance of the product or of payment, the risk passes to the Customer.
The Customer must inspect the product immediately upon receipt and report any damage or defects as well as deviations from the order without delay. Transport damage must be reported to the carrier immediately. Thereafter, the Customer may only assert hidden defects.
Defective products may no longer be used. Upon instruction by MTC GmbH, the product must be returned immediately.
5. No Right of Return or Withdrawal
The Customer has no right to return ordered products. An exchange is only possible for an unused product in its original packaging and only with the prior consent of MTC GmbH.
Any mandatory statutory right of withdrawal remains reserved. Custom Builds and special-order items are excluded from the right of withdrawal.
6. Warranty
The product descriptions and technical specifications as well as illustrations in the Online Shop or in documentation do not constitute a warranty of characteristics. If a product proves to be defective, the Customer has the right to rectification (repair) for defects reported in good time for a period of two years from delivery of the product. Rectification does not extend the warranty period. There is no entitlement to a replacement delivery. Any reimbursement to the Customer is measured according to the current value of the defective product. For a product with a running manufacturer's warranty, the Customer's warranty rights vis-à-vis MTC GmbH are governed by the existing rights vis-à-vis the manufacturer.
There is no warranty claim in the case of natural wear and tear or overuse, insufficient maintenance and care, improper storage, repairs carried out by non-authorised service centres, careless handling, disregard of operating instructions or safety regulations, incorrect assembly, missed servicing, unauthorised modifications (including repainting) and the use of incompatible spare parts or accessories (including tuning), as well as in the case of external influences and force majeure.
In all other respects, the statutory warranty is excluded in full. Mandatory statutory warranty rights remain reserved.
7. Liability
The liability of MTC GmbH is limited to intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law. Liability for auxiliary persons as well as for indirect or consequential damage and lost profit is excluded. If, under the preceding clause, there is no warranty claim, liability is likewise excluded. In any case, liability is limited to the price paid for the product concerned.
8. Retention of Title
Each ordered product remains the property of MTC GmbH until full payment. Dispositions of any kind (including sale or pledge) as well as the processing or alteration of a product that has not been paid for in full are not permitted without the prior consent of MTC GmbH. MTC GmbH is entitled at any time to arrange for an entry in the retention-of-title register.
9. Applicable Law and Place of Jurisdiction
The legal relationship between MTC GmbH and the Customer is governed exclusively by substantive Swiss law, to the exclusion of conflict-of-law provisions and of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention).
The exclusive place of jurisdiction for all disputes is Dietlikon, Switzerland. MTC GmbH reserves the right to take legal action against customers at their registered office or domicile.
10. Amendments to the GTC
MTC GmbH is entitled to amend these GTC at any time. The current version of the GTC can be viewed on the website at any time.
